Judge finds former state legislator McCollum willfully violated his release, revokes his bond

Former state Representative Austin McCollum had his bond revoked Monday after a Benton County judge found he willfully violated the terms of his release by being in the same place as his wife, despite a clear court order prohibiting any contact.

Judge Brad Karren made the ruling following a hearing on a motion filed by prosecutors seeking to revoke McCollum’s $10,000 bond. The bond, initially set after McCollum’s August 1 arrest on domestic violence charges, was increased to $75,000 as part of the judge’s decision. The hearing took place in Judge Karren’s chambers and was broadcast live into the courtroom.

McCollum, who is the Republican nominee for Benton County judge, was arrested again on September 29 on suspicion of felony stalking and violation of an order of protection concerning his wife. At the time of this second arrest, he was out on bond from the earlier case and explicitly prohibited from any contact with her.

This latest development complicates McCollum’s legal troubles amid the ongoing domestic violence case, with prosecutors signaling strong concern over the safety and well-being of Mrs. McCollum.

Attorney Shane Wilkinson, representing McCollum, was present during the hearing, though details of McCollum’s response to the violation were not made public. The fact that the judge described the violation as “willful” suggests the court found clear evidence McCollum knowingly flouted the no-contact order.

The original arrest in August, alongside the subsequent allegations, have cast a shadow over McCollum’s bid for Benton County judge, a position that carries significant responsibility for overseeing county government operations. The legal troubles may have a lasting impact on his campaign and public standing.

This is not the first time conversations in Bentonville courts have touched on contentious issues around domestic violence and order-of-protection enforcement. Local officials and advocates often emphasize the importance of strict compliance with these orders to protect vulnerable residents.

McCollum’s situation adds to a series of legal actions around local politicians in Northwest Arkansas making headlines recently. The increased bond amount indicates the court views McCollum as a higher flight risk or potential danger given the violation.

With the hearing concluded, McCollum’s legal team will likely face tough negotiations ahead. Meanwhile, Benton County residents watch closely as the case unfolds, given its implications for community safety and county leadership.
