Austin McCollum back in jail after being accused of stalking, violating protection order

Austin McCollum, a former Arkansas state representative and the Republican nominee for Benton County judge, was booked into the Benton County Jail Tuesday afternoon on new criminal charges. The 35-year-old Bentonville resident was arrested on suspicion of stalking and violating a protection order, according to jail records.

McCollum was booked at 4:35 p.m. and is currently being held pending a bond hearing. He was already out on bond following an August 1 arrest on domestic abuse-related charges. Those earlier charges include second-degree domestic battery, first-degree false imprisonment, and aggravated assault against a family or household member. McCollum has pleaded not guilty in that case.

Benton County Prosecuting Attorney Bryan Sexton said he is aware of McCollum’s arrest but declined further comment citing the ongoing investigation. McCollum’s attorney, Shane Wilkinson, also declined to make any statements regarding the latest charges.

The stalking and protection order violation charges allege McCollum did not adhere to court orders designed to prevent contact with the alleged victim. The specific circumstances leading to Tuesday’s arrest have not been publicly detailed. However, the new charges represent an escalation following McCollum’s August arrest.

Local officials maintain discretion in cases involving protection orders and domestic abuse allegations, often restricting details to protect victims. Still, McCollum’s status as the Republican nominee for Benton County judge has drawn significant public attention as legal proceedings continue.

McCollum served in the Arkansas House of Representatives before running for the judicial position. His campaign and public roles traditionally focused on law, justice, and governance, making the domestic allegations and related new charges particularly notable in Northwest Arkansas political circles.

He remains in custody at the Benton County Jail as the legal process unfolds. The next steps will include a bond hearing and continued investigation into the accusations of stalking and violating a protection order. Community members and voters considering McCollum’s candidacy for Benton County judge are closely watching these developments.

This marks the second time in less than two months that McCollum has faced jail time related to accusations from an intimate partner. The ongoing court proceedings will be pivotal in determining how these charges affect his professional and political future.

More updates are expected as bond hearings take place and the Benton County Prosecutor’s Office advances the case through the legal system. McCollum’s attorney has so far refrained from public comment, and the case remains under active investigation.
